We are not obligated to publish or use your User Content.  THEATLASNEWS.co is not in any manner endorsing any User Content that it may publish or post on the Site and cannot, and will not, vouch for its reliability.  Atlas News is not responsible for any User Content and has no duty to monitor the User Content posted on the Site.  You use any information contained in User Content or Atlas News Content at your own risk.  Atlas News and its designees have the right, in their sole discretion, to monitor, review, edit, remove, delete, disable, refuse, restrict, or terminate access to your User Content or the Site (in whole or in part) at any time, without prior notice and in our sole discretion, for any or no reason.  The obligations that you have to us under these Terms shall survive termination of the Site, any use by you of the Site, any User Content on the Site, or these Terms.  You will not continue to post any User Content that Atlas News has previously advised you not to post.

If you are under the age of 16, you may not submit any User Content to us.  If you are under the age of 18 but at least 16 years of age, you may submit User Content only with the permission of, and under the supervision of, a parent or legal guardian. If you are a parent or legal guardian agreeing to these rules for the benefit of an individual between the ages of 16 and 18, please be advised that you are fully responsible for his or her User Content and any legal liability that he or she may incur.

SUBSCRIPTION SERVICES

• Subscription Services.  Certain content may be available only through creation of a subscription account and payment of a fee (“Subscription Services”).  Through such Subscription Services accounts, you will have access to the Subscription Services for a specified term or billing period, which will be renewed automatically unless you cancel in accordance with our cancellation process described below under “Cancellation.”
• “Continuous Service,” By paying by credit card, you authorize us or our credit card service provider to charge your credit card or bank account for all fees for the subscription selected, payable in full at the beginning of each subscription period. You further authorize us to use a third party to process payments, and consent to the disclosure of your payment information to such third party.  Your subscription will automatically renew for another full subscription period at the then-offered price, unless you cancel your subscription, which you may do at any time by contacting customer service as described below under “Cancellation.”  Once subscription fees are paid, they will not be refunded.  Any cancellations will take effect for the next subscription period.
• Access Restrictions.  You are not authorized to access any Subscription Services unless you have opened a subscription account and paid the appropriate fee, have received access credentials (e.g., a username and password) from us, and are using those access credentials. You may not assist anyone else in accessing Subscription Services on an unauthorized basis, including by sharing your access credentials or providing any content or other materials that you obtained through Subscription Services to third parties. Sharing of your access credentials with Third Parties, whether within or outside your organization, is strictly prohibited. You are responsible for maintaining the confidentiality of your access credentials and for all usage or activity on your Subscription Services accounts. Such responsibility expressly includes any purchases made or other charges incurred on your credit card in connection with your use of the Subscription Services. In the event of any fraudulent, abusive or otherwise illegal activity on your Subscription Services accounts, we may, in our sole discretion, terminate those accounts and refer you to appropriate law enforcement agencies. You may be responsible for damages from any such fraudulent, abusive, or otherwise illegal activity.
• Age and Billing Authorization.  By subscribing to a Subscription Service, you confirm that you are at least 18 years of age, that all information you submit is true and correct (including all credit card information), and that you are the authorized holder of the credit card.
• Fees.  You agree to pay all subscription fees and other charges to your Subscription Services accounts, including any applicable taxes. Atlas News and/or the particular service provider reserves the right to change the amount of, or the basis for determining, any subscription fees or other charges for the Subscription Services and to institute new subscription fees or other charges without prior notice to you.
• Mobile Access.  Some Subscription Services are accessible only using a particular kind of device, such as an Apple iPad or an Amazon Kindle.  You should investigate Subscription Services before you pay for access to them to ensure that they will work with your device, because the Subscription Services may not work with all devices. We will not refund any fees you paid if the Subscription Services to which you subscribe are not compatible with your device.  Also, certain Subscription Services may not be available for use in every jurisdiction, and we will not refund any fees you paid if the Subscription Services to which you subscribe are not available.  For information on compatibility and availability, please visit the applicable provider’s website or contact us at support@THEATLASNEWS.co before you subscribe.
• Suspension or Termination.  We may suspend or terminate your access to Subscription Services at any time without notice to you.  If we do so, you will not be responsible for fees associated with the Subscription Services after the termination becomes effective, but you will not have any other remedies against us, and we will not issue any refunds.  If you have breached or violated any obligation under these Terms, you will not be entitled to any remedy.
• Cancellation.  You may have the ability to cancel or modify our subscription within your account page found on the Site. Furthermore, your cancellation notice may be sent to support@THEATLASNEWS.co, or by mail at: Atlas News, Attention: Cancellation, 5600 SMU Boulevard Dallas Texas 75206 In order for your cancellation to be effective for any new billing period, we must receive your notice of cancellation at least forty-eight (48) hours before the new billing period begins. Late or incomplete cancellation notice may be honored solely at our discretion. We do not refund subscription for any reason. IF you have a free trial, you may cancel in the trial period. Once your subscription becomes paid, we do not refund at all. Requests to terminate subscriptions will be effective once the billing period in which we received the cancellation concludes.
   

REGISTRATION FOR NON-SUBSCRIPTION SERVICES

You may be asked to register for certain activities in connection with the Site other than Subscription Services. When you register, you agree to provide accurate, current and complete information about yourself as requested or directed and to promptly update this information to maintain its accuracy.  Atlas News has the right to suspend or terminate any account or other registration and to refuse any and all current or future use if it suspects that such information is inaccurate or incomplete.  You are responsible for maintaining the confidentiality of any password and username that you are given or select, and you are responsible for all activities that occur under your password or account.

NON SUBSCRIPTION PAYMENTS AND INVOICING

You may, for various reasons, pay, or receive payment to/from ATLAS NEWS that is not under the same scope of subscription policies. This includes, but is not limited to, invoicing for one-off payments that are not related to the typical business by ATLAS NEWS. These invoices will be processed through our payment providers at STRIPE. These payments, due to their nature, are not refundable. ATLAS NEWS conducts business with various advertising partners, contractors, and individuals for different reasons. Due to the varying nature of what invoices are used for; services rendered, and goods sold are not returnable and shall not be refunded. Invoices may be created directly through STRIPE, or by a 3rd party integration. All invoices will come with a transaction reciept, or a bill of sale, for services and goods sold respectively. Both parties, including Atlas News, are aware that invoices are not covered by any protection policy and once an invoice is paid, it is final and non-refundable unless otherwise stated in a separate contractual agreement signed by representatives from both parties. 

INTELLECTUAL PROPERTY

All content, information, materials, computer code, and software that are part of the Site other than your User Content (collectively, the “Atlas News Content”) is the property of Atlas News or third parties.  You may access, use and display the Site on a single computer or device and download and print copies of the Atlas News Content only for non-commercial, informational, personal use, without modification or alteration in any way, and only so long as you comply with these Terms.

• Copyright and Other Intellectual Property Rights.  The Atlas News Content is protected under the copyright laws of the United States and other countries.  You acknowledge that all copyrights and other intellectual property rights in the Site are owned by Atlas News or its third-party licensors to the full extent permitted under the United States Copyright Act and all international copyright laws and all other applicable laws.  Unless expressly permitted by an authorized person in writing, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works from, transmit, or in any way use or exploit any part of the Atlas News Content except that you may make use of the content for educational and non-commercial purposes only, provided that you maintain all copyright and other notices posted along with the Atlas News Content.  To obtain written consent to use a copyrighted work, please contact us using the information in Section 18.  Copying or downloading these materials for anything other than your personal use is a violation of these Terms.
• Trade and Service Marks.  All rights in product names, the Atlas News name, trade names, lotheatlasnews.cos, service marks, trade dress, slogans, product packaging, and designs of Atlas News products or services, whether or not appearing in large print or with the trademark symbol, belong exclusively to Atlas News or its licensors and are protected from reproduction, imitation, dilution, or confusing or misleading uses under national and international trademark and copyright laws.  The use or misuse of these trademarks or any materials, except as permitted herein, is expressly prohibited, and nothing stated or implied on the Site confers on you any license or right under any patent or trademark of Atlas News, its affiliates, or any third party.  To obtain written permission to use the trade and service mark rights of Atlas News, please contact us using the information in Section 18.

INDEMNIFICATION

Upon a request by us, you agree to defend, indemnify, and hold harmless us and our parent and other affiliated companies, as well as any respective employees, contractors, officers, directors, agents, content providers, licensors, licensees, distributors, representatives and other authorized users, and each of the foretheatlasnews.coing entities’ respective resellers, distributors, service providers and suppliers, and all of the foretheatlasnews.coing entities’ respective officers, directors, owners, employees, agents, representatives, successors and assigns (collectively, the “Indemnified Parties”) harmless from and against any and all losses, damages, liabilities and costs (including, without limitation, settlement costs and any legal or other fees and expenses for investigating or defending any actions or threatened actions) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms or claims arising directly or indirectly from your use or misuse of the Site .   We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with us in asserting any available defenses.

INTERNATIONAL USE

We make no representation that any content of the Site is appropriate or available for use in locations outside the United States. Accessing the Site from territories where the content is illegal is expressly prohibited.  If you choose to access the Site from a location outside the United States, you do so on your own initiative and you are responsible for compliance with all applicable local use controls, laws and regulations, including those relating to the transition of technical data exported from or imported to the country in which you reside. GENERAL TERMS; SEVERABILITY & INTEGRATION; NO WAIVER

This contract and any supplemental terms, policies, rules, and guidelines posted on the Site constitute the entire agreement between you and us and supersede all previous written or oral agreements. If any part of the Terms is held invalid or unenforceable under the law of the United States or any U.S. jurisdiction or under the law, rules or regulations of a particular country, the invalidity of such provision shall not affect the validity of the remaining provisions.  The failure by either party to assert their rights hereunder shall not be deemed a waiver of those rights.  Any waiver of any provision by us must be in writing and signed by Atlas News to have effect.

COMMUNITY GUIDELINES

Overview:
 

Community is the heart of Atlas News. It’s how we have grown so quickly and have such good engagement. And with our ever-changing integrations and platforms, these community guidelines are needed to keep everyone in check. We are not interested in censoring different perspectives as large social media companies do. But we are also not interested in having a toxic community. Some of you will get banned, and if you do, then you deserved it.

In order to meet the goals of this community, it’s important for members to feel like their comments and opinions can be respected by people with shared interests. That interest is public discourse in a healthy, but productive manner. We aren’t going to ban people because they cuss or say something rude. But if you are a persistent asshole and we think you need to go, then we will ban you. As such, we request that you read and adhere to the guidelines that follow.

Guidelines:

Treat others online as you would treat them in real life. Don’t be overly sensitive to the point it halts discussion, but also don’t be rude just to be rude. 

Be tolerant towards others’ viewpoints; respectfully disagree when opinions do not align. Give fact-based rebuttals. 

Respect the privacy and personal information of other members

Communicate with courtesy and respect for not only other members, but Atlas News staff, reporters, and mods. 

Please do not:

• Do NOT make personal attacks on other community members
• Do NOT use defamatory remarks or make false statements against others
• Do NOT blast hate speech. There is a difference between analyzing the political movements of the Nazi party as part of a community thought exercise, and bluntly supporting genocide. Don’t be an idiot.
• Do NOT discuss, disperse, move, talk about, engage with, download, upload, or otherwise interact with sensitive information including but not limited to: classified documents, state secrets, others’ personal information, private corporate statements, or personally sensitive information. 
• Do NOT sell or otherwise transfer your account. Some community members will be verified and marked as “trusted partners. If you earn this badge, it is yours. Do not sell or otherwise transfer your account to another person unless explicitly given permission by Atlas News.
• Do NOT send death threats, or call for physical violence to or from anyone. 

Use messaging/email responsibly

All Atlas News tools are intended to keep the community in touch with one another, to help facilitate discussion, and to promote the common interests of our customers. Some healthy examples of this community might include:

• Discussing how to better understand a topic or category
• Sharing tools for OSINT
• Inviting other community members to join a discord group
• Telling other people about cool partners of Atlas News, like WRMFZY

Consequences:

These guidelines are short on purpose. We aren’t Twitch. We aren’t Facebook. We have one of the best communities online and have trust in their ability to behave within reason. But as we grow, there will be people who are not a part of the ‘OG followers’ who may violate our community guidelines. We will take action when we see someone violating these guidelines. Sometimes that just means giving someone a warning; other times it means revoking certain privileges or accounts entirely. You may not like the actions we take against your account. But rest assured: if you don’t do anything wrong, you won’t have to worry. Account warnings, suspensions, shadow bans, or permanent bans are all decided on, and implemented by, our community mods. If you have a question about the action taken on your account, you can send an email to mod@theatlasnews.co. Journalists, support staff, and senior-level executives do not play a role in modding our community. 

Technical Support:
Sometimes there may be service interruptions in our commenting system, which is built by Viafoura. Here are a few links that may help troubleshoot your issues. IF you cannot find a solution to your issue, send an email to mod@theatlasnews.co. But please, at least try.

For issues with login not working:
 You may be experiencing cookie passthrough issues where one login system does not communicate with another, resulting in UX problems. Most notably, you log in to one system and it doesn’t pass through the credentials to another system. Ex- you log in to the app, but can't comment because you are not logged into the commenting platform. In this case, you will need to clear cookies and enable 3rd party cookie access.

TERMINATION

Your right to use the Site automatically terminates if you violate the Terms or any rules or guidelines posted in connection with the Site. We also reserve the right, at our sole discretion, to terminate your access to all or part of the Site, for any reason, with or without notice.  IF you violate community chat guidelines, you will be terminated without notice. If you subvert this termination by creating a new account, you will be auto-banned on the new account. Repeated violations from the same IP address will result in an IP ban which means you will not be able to access any Atlas News products including the website and app.
