Delhi High Court Issues Notice to Agency Over Arrest of Chief Minister

On March 27th, the Delhi High Court issued a notice to the Enforcement Directorate (ED) regarding the case of the agency arresting Delhi Chief Minister Arvind Kejriwal. In the ruling, the Court raised questions regarding the “legality and validity” of the arrest and remand.

The Court requested that the ED respond to the main petition and its application for the interim release of Kejriwal by April 2nd.

The judge said that any release order granting Kejriwal bail is an interim measure. Furthermore, the judge said that the writ jurisdiction under the country’s Constitution’s Article 226 is not a “ready substitute” to fix the issues surrounding the “remedy of bail under Section 439 of the CrPC ordinarily.
